| Description: 5. (1) Subject to the provisions of subsection (2) and section 6, any person shall be guilty of an offence if he - (c) sells, or imports for sale, any foodstuff, cosmetic or disinfectant described in a manner referred to in paragraph (b). (2) The provisions of subsection (1) shall not be deemed to prohibit the description of any foodstuff by, or its sale or importation under, a geographical name which is generally accepted as a generic term for a particular type or variety of such foodstuff, provided that foodstuff described by or sold or imported under the name in question is of the type or variety indicated by that name. |
