Trade Measures and Regulations

Manufacturers or importers must apply to the regulator for registration of their manufacturing facility to ensure compliance with NAMS/EN 197-1 and NAMS/EN 197-2 standards. The application must include details of the cement type, manufacturing facility, a recent cement test report, and packaging information. The regulator will assess the application. Importing or trading cement from an unregistered facility is an offense, punishable by a fine of up to N$5,000, imprisonment for up to six months, or both.

The Minister may make regulations in relation to the transportation, processing, sale and exportation of forest produce and the issuing of permits, licences or other documents required for those activities;

The Minister has the authority to create regulations necessary to achieve the goals of the Act. These regulations can cover various aspects, such as health certification for aquatic organisms, disease control, and the regulation of import, export, and sale of aquaculture products.

Importers of controlled products must register with the Board and hold the necessary certificates for horticultural trading or milling. Entities involved in the production, processing, storage, and marketing of controlled products must also submit required information to the Board.

A refund of an export levy can be requested within five years of payment, and the Commissioner can extend this period if unforeseen circumstances prevented timely submission. Refunds may not be granted if the levy was paid correctly, the exporter failed to declare customs properly, or if the refund amount is below a set minimum, and any refunds made in error must be repaid if demanded.
