Prohibition of Export of Livestock without Permit

Summary:

Livestock export or consignment to controlled abattoirs requires a non-transferable permit from the Board, which controls the quota and allotment process. Licensed farmers or speculators must submit a declaration and permit application to the Board at least six weeks before export or consignment. Additionally, all applicable levies must be paid before the livestock can be exported.

Description:

12. (1) No livestock shall be exported from the Territory to the Republic of South Africa or consigned to any abattoir within the Territory and under the control of the Board or the Livestock and Meat Industries Control Board, except under a permit, being Form A, issued by the Board. Such permit shall not be transferable, except with the permission of the Board, previously obtained. Quotas for such permits shall be allotted by the Board which shall have absolute discretion to make such allottments as it may deem fit.

(2) Every bona fide farmer or bona fide speculator in livestock, duly licensed in the Territory, desiring to export livestock or to consign livestock to a controlled abattoir within the Territory, shall submit a declaration on the prescribed form, being Form C in the Schedule to these regulations, on a date or dates to be fixed by the Board from time to time. The said form can be issued only by the Board. In addition to the aforementioned declaration every farmer or speculator in livestock shall submit to the Board an application for a permit on the prescribed form, being Form D in the Schedule of the regulations, at least six weeks before the date on which he desires to export the livestock or to consign it to a controlled abattoir within the Territory. No stamp duty shall be payable to the Administration in respect of such declaration or application form. It shall be in the discretion of the Board, for the Board, for the purposes of allotting a quota, to decide whether an applicant is a bona fide farmer or bona fide speculator in livestock.

12A. No person shall export livestock from the Territory to a destination other than the Republic of South Africa except under authority of a permit issued by the Secretary for Agricultural Economics and Marketing or otherwise than in accordance with the conditions specified in such a permit.

13. (a) No livestock shall be exported until the amount due in respect of the levies and special levies referred to in section 6 of the Meat Control Ordinance, 1962 (Ordinance 20 of 1962) has been paid.
