Importation of plants, plant products and other regulated articles

Summary:

In Namibia, importing plant material, pests, soil, or other specified items requires a permit and must be done through designated entry points with proper documentation. Failure to follow these rules can result in a fine of up to N$20,000 or imprisonment for up to 2 years.

Description:

(1) Subject to subsection (3), a person must not import into Namibia -

(a) any plant material, plant pest, beneficial organism, soil or packaging; or

(b) any other object or material which has been specified by the Minister by notice in the Gazette, except if the person holds a permit issued under this Act that authorises importation thereof.

(2) Subject to subsection (3), a person who imports a regulated article must ensure that the article -

(a) is brought into Namibia only through a designated point of entry;

(b) is declared and presented to a plant quarantine officer for inspection on its arrival; and

(c) is accompanied by a phytosanitary certificate issued by the plant protection authority of the country from where it is exported, or by any other certificate or document of permission issued in that country as may be prescribed.

(3) The Minister may exempt, by notice in the Gazette or by regulation, any plant material or class of plant material as may be specified from the requirements of subsection (1) or from the requirements of either paragraph (b) or (c), or both paragraphs (b) and (c), of subsection (2), and specify conditions applying in relation to any such exemption.

(4) A person who contravenes subsection (1) or a provision of subsection (2) commits an offence and is liable to a fine not exceeding N$20 000 or to imprisonment for a period not exceeding 2 years, or to both such fine and such imprisonment.
