Under the Import and Export Control Act, 1994, the following measures are implemented:

1. Prohibition on Importation:
   - The importation of second-hand motor vehicles older than 12 years into Namibia is prohibited for specific categories of vehicles listed in Annexure A, if they are from outside the common customs area defined in the Customs and Excise Act, 1998.
   - The same prohibition applies to vehicles registered within the common customs area for less than two years before importation into Namibia.

2. Exemptions:
   - Certain vehicle categories listed in Annexure B are exempted from these importation prohibitions.

3. Designated Port of Entry:
   - Walvis Bay is designated as the sole port of entry for all second-hand motor vehicles imported from outside the common customs area.

4. Repeal of Previous Notices:
   - Previous Government Notices Nos. 257 of 16 November 2004

Control of medicines and scheduled substances Restriction

A person may not engage in the following activities concerning medicines or scheduled substances without the appropriate licenses and permits:

1. Manufacture or Pack and Sell:
   - Cannot manufacture or pack and sell medicines or scheduled substances unless holding the relevant license and complying with specified conditions.

2. Import or Export:
   - Cannot import or export these substances without the necessary license and compliance with Council-determined conditions.

3. Scheduled Substances (Schedule 3 or 4):
   - Additional permits are required for manufacturing, packing, selling, importing, or exporting these substances, alongside the necessary licenses.

4. Sale Restrictions:
   - Manufacturers, importers, or wholesale dealers cannot sell medicines or substances to unauthorized persons. However, authorized prescribers and pharmacists may sell them for consumption, subject to other provisions.

1. Only goods specified in a permit may be imported into Namibia.

2. The permit cannot be transferred to or used for the benefit of anyone not named in it.

3. The permit is valid for 12 months from the issue date or a shorter period as specified.

4. Goods requiring an import permit cannot be shipped to Namibia without a valid permit.

5. The permit must be issued without unauthorized amendments; any such changes will invalidate it, and it will be confiscated.

6. The permit does not exempt the importer from complying with other regulations related to importing goods into Namibia.

Prohibition relating to export of unpolished diamonds Prohibited Goods

No one is allowed to export unpolished diamonds from Namibia unless they meet specific criteria: they must be a producer, a holder of a prospecting licence, a dealer, a permit holder, or acting under a lawful agreement with one of these parties. Violating this law is a serious offense, punishable by a fine of up to N$1,000,000, up to 20 years in prison, or both.

Export of Polished Diamonds General

Anyone planning to export polished diamonds of a specified weight from Namibia must notify the Minister at least 14 days in advance. The Minister may examine the diamonds within this period to confirm they are polished. If confirmed, the diamonds must be sealed before export. If the Minister does not examine the diamonds within 14 days, they can be exported without examination or sealing. Violating these regulations can result in a fine of up to N$1,000,000, up to 20 years in prison, or both.

Prohibition of sale, manufacture or importation of certain articles Prohibited Goods

Under the law, it is an offense to:

1. Sell, Manufacture, or Import:
   - Foodstuffs, cosmetics, or disinfectants with prohibited substances, or those containing higher levels of substances than permitted.
   - Products that do not meet prescribed standards or are prohibited by regulations.
   - Contaminated, impure, decayed, or harmful products.

2. Treat or Alter Products:
   - Using prohibited substances or methods that make the product harmful to health.

Exceptions:
- The provisions do not apply if a foodstuff contains a non-harmful substance necessary for its proper condition, or if the substance is within regulated limits and not intended to deceive.


- "Manufactures" includes altering products in ways that make them prohibited by this law.

Harvesting, Transportation, Processing, Sale, Importation, Transit, and Exportation of Forest Produce and Issuing of Permits, Licences and other Documents Required for those Activities Permit Requirement

The passage outlines regulations requiring licences or permits for harvesting, transporting, selling, marketing, exporting, and importing forest produce. General dealers are exempt from needing a marketing licence but must prove legal procurement. Exporting unprocessed forest produce is restricted unless authorized for special purposes. A true copy of the relevant licence must accompany forest produce during transport. Importing forest produce requires an import permit and proof of export from the origin country. Farming or trading honey-producing organisms also requires authorization, and honey harvesting is restricted from September to December unless the organisms are fed.

Conditions of Wholesale License General

General conditions for wholesale licenses include:

1. Compliance: Adhere to the Act, Regulations, and other applicable laws related to labor, safety, hazardous substances, security, health, and environment.
2. Bulk Sales: Sell fuel only in bulk quantities.
3. Sales Restrictions: Fuel sales to entities other than specified ones must follow regulation 8 and only occur at the wholesaler's dispensing point.
4. Approvals and Permits: Obtain all necessary import, export, and wholesale approvals and permits.
5. Record-Keeping: Maintain and submit required records and information to the Minister.
6. Specifications: Ensure petroleum products meet approved specifications.
7. Storage Facilities: Abandon storage facilities only as per Regulations.
8. Duties and Taxes: Pay all applicable duties, levies, and taxes.
9. Facility Changes: Notify the Minister of any changes to storage facilities before making them.
10. Dangerous Situations: Report any dangerous situations and corrective actions to the Minister.
11. Spill Regulations: Follow Regulations related to petroleum product spills.

The Minister may impose additional special conditions on a wholesale license.
