Trade Measures and Regulations

The board has the authority, with the Minister's approval, to require certain people or groups involved with controlled products to keep records and provide information. It can also prohibit the sale or export of controlled products unless the producer or speculator is registered and meets the board's conditions. Additionally, no one can export controlled products from Namibia without a permit issued by the board if such exports are prohibited.

In Namibia, telecommunications equipment must be approved or exempted from approval before it can be connected to an electronic communication network or sold. However, temporary imports for research or demonstration purposes may be allowed without approval for up to six (6) months, provided the importer obtains authorization from the relevant Authority.

Certain telecommunications equipment listed in Annexure B are exempt from type approval and must be recorded in a register published by the Authority. The Authority can also publish a list of prohibited telecommunications equipment, which cannot be imported, sold, or connected, and may restrict the importation of equipment that poses risks or interference.

Under the Import and Export Control Act, 1994, the following measures are implemented:

1. Prohibition on Importation:
   - The importation of second-hand motor vehicles older than 12 years into Namibia is prohibited for specific categories of vehicles listed in Annexure A, if they are from outside the common customs area defined in the Customs and Excise Act, 1998.
   - The same prohibition applies to vehicles registered within the common customs area for less than two years before importation into Namibia.

2. Exemptions:
   - Certain vehicle categories listed in Annexure B are exempted from these importation prohibitions.

3. Designated Port of Entry:
   - Walvis Bay is designated as the sole port of entry for all second-hand motor vehicles imported from outside the common customs area.

4. Repeal of Previous Notices:
   - Previous Government Notices Nos. 257 of 16 November 2004 

To access, research, or commercialize biological and genetic resources in Namibia, or to export them, you must apply for an access permit and follow specific regulations. Additionally, you need an export permit and a material transfer agreement to transfer these resources or associated traditional knowledge.

The registrar may either refuse or grant an application for an import or in transit permit, issuing it in the specified forms, with the permit's validity limited to the period indicated, after which reapplication is necessary if importation is still desired.

To export regulated materials from Namibia, you must apply for a phytosanitary certificate from the Ministry of Agriculture, Water, and Forestry using Form AP 4 and pay the required fee. The materials will be inspected by a plant quarantine officer, and if found free of pests or disease, a phytosanitary certificate will be issued.
